Terms and Conditions:

This User Agreement (“Agreement”) governs the access to and use of the marine forecast platform, data services, and associated digital content provided by Ocean Hydro Sdn. Bhd. (hereafter referred to as the “Provider”). By accessing, subscribing to, or using the Platform (hereafter referred to as the “Platform”), you, the “Recipient,” acknowledge that you have read, understood, and agreed to be bound by the terms set forth in this Agreement. If you do not agree with these terms, you must discontinue use of the Platform immediately. Continued use of the Platform following any updates or changes constitutes acceptance of the revised Agreement.

Where access credentials are issued, the Recipient agrees to provide accurate and current information when required, and remains fully responsible for maintaining the confidentiality of all login credentials. All activity conducted under the Recipient’s account is deemed to be the responsibility of the Recipient. The Provider shall not be held liable for any unauthorized access or misuse resulting from failure to safeguard login information.

The Recipient agrees to use the Platform strictly for lawful and authorized purposes. The Platform must not be used in any manner that disrupts, damages, or interferes with its performance or with other users. Prohibited activities include, but are not limited to, attempting to gain unauthorized access, modifying system functions, introducing malicious software, exploiting system vulnerabilities, or engaging in any actions that could compromise system integrity. The Provider reserves the right to suspend or terminate platform access at any time, without prior notice, should any misuse or violation of this Agreement be detected.

All Platform Content including marine forecasts, hindcast data, analytical outputs, maps, visualizations, software, and tools remain the exclusive property of the Provider or its licensors. Intellectual property laws, including copyright and trademark regulations, protect all content available on the Platform. The Provider grants the Recipient a limited, non-exclusive, non-transferable right to access and use Platform Content solely for operational, educational, or research-related purposes as permitted. The Recipient may not reproduce, modify, redistribute, or create derivative works from any Platform Content without prior written permission from the Provider.

The Platform and all data provided through it are supplied on an “as is” and “as available” basis. Although the Provider strives to ensure data accuracy and reliability, no guarantee is made that the Platform will be free from interruptions, errors, or inaccuracies. The Provider does not warrant that the outputs will meet any specific expectations or requirements. To the maximum extent permitted by law, the Provider disclaims all liability for direct, indirect, incidental, or consequential damages arising from the Recipient’s use of or reliance on the Platform.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services. This means if you experience problems as a result of using our services, there are limits to the types of damages you can claim from us.

The Provider reserves the right to modify, update, or discontinue any part of the Platform at its sole discretion. The Recipient’s access to the Platform may also be restricted or terminated if continued use is deemed to violate this Agreement or pose operational or security risks. Upon termination, the Recipient must cease all access to and use of the Platform.

This Agreement shall be governed by and interpreted in accordance with the laws of Malaysia. Any disputes arising from or related to the Platform or this Agreement shall fall under the exclusive jurisdiction of the Malaysian courts. If any portion of this Agreement is deemed unenforceable, the remaining provisions shall continue in full effect. This document represents the complete understanding between the Provider and the Recipient regarding use of the Platform and supersedes all prior agreements or communications related to these Terms.

Private Policy:

This Privacy Policy describes how Ocean Hydro Sdn. Bhd. (hereafter referred to as the “Provider”) collects, uses, manages, and protects information obtained through its marine forecast platform, data services, and associated content (collectively referred to as the “Platform” or “Platform Content”). By accessing, subscribing to, or using the Platform, you (hereafter referred to as the “Recipient”) acknowledge that you have read, understood, and agreed to the practices described in this Privacy Policy.

The Provider may collect certain information required to operate and maintain the Platform effectively. This includes information voluntarily provided by the Recipient during account creation or onboarding, such as username, organization details, industry type, and any additional data submitted for system access or support. The Provider may also automatically collect system-generated information, including device data, IP addresses, login timestamps, navigation activity, and performance logs, to ensure secure and reliable service.

All collected information is used solely for purposes related to Platform operation, including account authentication, service delivery, system performance monitoring, security enhancement, and user support. The Provider may also process information to troubleshoot issues, analyze usage trends, optimize system features, and meet legal or regulatory requirements. The Provider does not sell, rent, or distribute personal or organizational information to external parties for marketing or commercial gain.

Information may only be disclosed to third parties when required for essential Platform operations such as system hosting, technical support, analytics or when legally obligated by regulatory authorities or legal proceedings. Any third parties engaged by the Provider are bound by strict confidentiality and data protection requirements to ensure the Recipient’s information remains secure. The Provider employs appropriate administrative, technical, and organizational safeguards including secure servers, restricted access controls, encryption practices, and continuous monitoring to protect information stored or processed through the Platform. However, the Recipient acknowledges that no digital or online system can guarantee absolute security.

The Provider retains collected information only for as long as necessary to fulfill operational, contractual, or legal obligations. When information is no longer required, it is securely erased or irreversibly anonymized. Recipients may request access to their stored information, seek corrections, request deletion where appropriate, or inquire about how their information is used. All requests may be directed to the Provider using the contact information provided at the official website.

The Platform may use cookies or similar technologies to support functionality, track system performance, and enhance the Recipient’s user experience. Recipients may disable cookies through browser settings; however, certain features of the Platform may not function correctly as a result. The Provider reserves the right to update or revise this Privacy Policy at any time to reflect changes in operational practices, legal requirements, or Platform enhancements. Continued use of the Platform following the posting of updates constitutes the Recipient’s acceptance of the revised terms.
